Legal Rights

Law No. 5378 on Persons with Disabilities, enacted in 2005, guarantees fundamental rights of people with disabilities in Turkey. Accessibility obligations, employment quotas, anti-discrimination provisions, and the right to access social services are covered by this law.

KVKK (Personal Data Protection Law No. 6698) contains special provisions for processing health and disability data of individuals with disabilities. This data is classified as 'sensitive personal data' and explicit consent is required for processing. Our association operates in full compliance with KVKK.

Individuals with a disability rate of 90% or above are completely exempt from Special Consumption Tax (ÖTV) when purchasing vehicles. For disability rates below 90%, reduced ÖTV applies under certain conditions. Additionally, vehicles owned by people with disabilities and their dependents are exempt from Motor Vehicle Tax (MTV).

SGK disability rights include disability allowance, free medication and medical equipment, care support, early retirement options, and home health services. A ÇÖZGER or disability report is generally required to benefit from these rights.

The UN CRPD, ratified by Turkey in 2009, guarantees the civil, political, economic, social, and cultural rights of people with disabilities at an international level. The convention covers core areas such as accessibility, independent living, access to education, and combating discrimination.
